    A Motorcyclist's Guide to Staying Safe from Reckless Drivers

    As a motorcyclist, you run a much higher risk of injury than drivers, simply because you are less protected from an impact with the road or other vehicles. Often, drivers are reckless and this increases your risk of injury even more. To keep yourself as safe as possible when on the road, follow these tips:

    • Slow down when approaching intersections. Many motorcycle accidents happen when a car is turning left at an intersection and does not see a motorcycle approaching from the opposite direction. In order to avoid this type of accident, slow down slightly as you approach an intersection. This will provide drivers with more time to notice you and respond.
    • Be aware of blind spots. Reckless drivers don’t always check their surroundings carefully, especially their blind spots. With this in mind, a driver’s quick lane change could cost you your life if your motorcycle is in his blind spot. Try to stay in front of or behind a car, within the driver’s range of vision. If you’re riding around semi-trucks, be especially careful, because their blind spots are even larger.
    • Ride defensively. Even though cars should do their part to avoid you, you also have to be proactive. Do your part to stay safe by driving defensively. Go the speed limit, be courteous to other drivers and stay aware of your surroundings. Even if other drivers are reckless, you’ll be able to react calmly and quickly to any changes in traffic.
    • Wear protective clothing. You should always wear a helmet, heavy jacket and sturdy boots whenever you ride your motorcycle. This outfit will protect you from road rash and other injuries if you are in an accident. On a motorcycle, you are more vulnerable to injury than drivers in cars and you need to take steps to protect yourself.

    Who can be Held Liable for Injuries Sustained in Truck Accidents?

    Accidents involving semi-trucks can be especially dangerous because these vehicles are so large, giving them more momentum and conveying more force when they hit an object. When one of these devastating collisions occurs, one of several parties may be responsible:

    • The driver. In some cases, an accident with a truck may be the result of operator error, perhaps due to simple carelessness, drug use or fatigue. Under federal regulations, drivers can only work a certain number of hours within a certain time span, though many disregard these limits in an attempt to complete trips more quickly and make more money. To facilitate this, they may also take drugs. Any one of these factors can lead to an accident. If more than one of the above factors is present, it can be a catastrophe.
    • The trucking company. Companies may push their operators to drive above the legal number of hours, in order to complete trips faster and bring in more money. If an operator can prove that he worked excessive hours at the behest of his employer, the employer may be held liable for the resulting accident. Additionally, trucking companies have a responsibility to keep their vehicles in good condition. If they fail to do so and a resulting mechanical failure causes an accident, they may be liable.
    • The truck manufacturer. If a mechanical failure results from a defect in the truck rather than poor maintenance, the manufacturer is at fault. This can be the result of a poorly designed component that does not function efficiently or a poorly manufactured component that breaks or malfunctions, despite the driver’s correct operation and the company’s correct maintenance.

    Our client, a 43-year-old New Port Richey motorist, was hit in 2007 by an uninsured driver who ran a stop sign. Our client had uninsured motorists' coverage and the lawsuit was against his own insurance company, 21st Century. Our client's insurance policy was for $100,000, but 21st Century wouldn't pay the claim.
